The principle that fairness requires a right to be heard for those affected by a decision has been translated in some circumstances into a right to be consulted about public policymaking, conferring some limited participation rights.

Because of the nature of this decision-making, the scope of those entitled to such rights should be cast much more widely than is the case, for instance, where natural justice is the justifying principle.

For public policymaking to have a rational base, there should be strong consultation and participation rights conferred in the public interest and not restricted to cases where a ‘quasi-private interest is affected.

In the following section, we want to consider the extent to which our public law structures and protects such consultation and participation rights.
