Most recently, the First Section Chamber of the Court noted in Schalk and Kopf v Austria that signatory states are not currently required to grant legal recognition to same-sex partnerships.
However, this is unlikely to be the last word on same-sex partnerships: for one thing, the case was not decided by the Grand Chamber, and for another, the First Section Chamber repeatedly emphasized that the application of the Convention depended very strongly on the Court’s interpretation of evolving social attitudes to same-sex partnerships among the signatory states.
