The courts have developed a number of exceptions to the general rule that no reasons need be given at common law.
The courts may hold, for example, that a failure to give reasons will prejudice an applicant’s chances of successfully applying for judicial review, or that a failure to give reasons amounts to arbitrariness,101 or that legitimate expectations have been created which demand that any departure from that expectation be explained or, more sweepingly, that in the interests of fairness, reasons must be given.
